1. Nature of Services
- Field & Cattle operates as a marketplace platform connecting consumers with independent farmers for the purchase of beef and related livestock products.
- We do not raise, butcher, or process cattle ourselves. All beef and livestock products are provided directly by the farmers.
- Farmers remain responsible for compliance with all applicable state and federal laws, including USDA or custom-exempt regulations.
2. Orders and Payment
- Orders placed through Field & Cattle constitute agreements between the buyer and the farmer.
- Deposits and final payments may be required before cattle are processed. Specific timelines will be communicated at the time of order.
- Field & Cattle may collect payment on behalf of the farmer and transfer funds, but we are not responsible for product quality, processing timelines, or farmer performance.
3. Delivery and Pickup
- Delivery or pickup arrangements will be coordinated directly with the farmer or a delivery partner.
- Field & Cattle is not liable for delays, spoilage, or loss once the product is delivered to the agreed location.
- Customers are responsible for providing accurate delivery addresses and ensuring someone is available to receive orders.
4. Custom Exempt and USDA Sales
- Some farmers may sell beef under custom-exempt processing, which requires customers to purchase a live share of the animal before slaughter.
- Other sales may be through USDA-inspected facilities, which allow resale by the cut.
- Customers are responsible for understanding these differences before making a purchase.
5. Refunds and Cancellations
- All sales are considered final once processing has begun.
- Refunds or cancellations may be offered at the sole discretion of the farmer. Field & Cattle may assist with disputes but does not guarantee refunds.
6. Liability
Field & Cattle is a broker and facilitator only. We are not responsible for:
- The health, safety, or quality of beef sold.
- Processing, packaging, or handling of beef.
- Compliance by farmers with regulations.
To the fullest extent permitted by law, you agree to release and hold harmless Field & Cattle from claims related to the use of our services.
7. Subscription Service
Field & Cattle offers subscription services that provide access to farm data, profiles, and communication features:
- Monthly Access: Subscription-based access to farm profiles, pricing, availability, and messaging features. Billed monthly and can be canceled at any time.
- Concierge Package: One-time payment for extended access with additional concierge services.
- Subscription fees are non-refundable except as required by law or at our sole discretion.
- Access to subscription features will be revoked if payment fails or subscription is canceled.
- We reserve the right to modify subscription pricing, features, or terms with reasonable notice to subscribers.
8. Messaging and Communication
Field & Cattle facilitates communication between users and farmers through our messaging system:
- Messages sent through our platform are received by Field & Cattle and then forwarded to the intended farmer.
- Not all messages are forwarded directly to farmers. We may review, moderate, or filter messages to ensure appropriate communication and prevent spam or abuse.
- We are not responsible for the content of messages sent by users or responses from farmers.
- Users agree to use the messaging system only for legitimate inquiries related to farm products and services.
- We reserve the right to block, filter, or refuse to forward messages that violate our terms or are deemed inappropriate.
9. User Responsibilities
- You agree not to misuse the platform, submit false information, or attempt to bypass our systems.
- Customers must be at least 18 years old to place an order or subscribe to our services.
10. Changes to Terms
We may update these Terms from time to time. Continued use of our services means you accept the updated Terms.
